Acknowledgement of Terms

| This Sawmill Athletic Club, Inc., d/b/a Premier at Sawmill Membership Agreement is comprised of this cover page, the Terms and Conditions, the Notice of Cancellation, any Release of Liability or Parent/Guardian Release of Liability and any other terms and conditions of Membership attached hereto and made a part hereof, or any subsequent “Change Form” (described herein) (collectively, the “Membership Agreement”). The parties hereto do hereby execute this Agreement to be effective as of the Membership Agreement Execution Date (attach additional signature pages, if needed): |
a. If the Primary Member wishes to cancel this Membership Agreement at the expiration of the Initial Term or any time during the Renewal Term, the Primary Member must give a 30 day notification in person or a 30 day written notification by U.S. Postal Service, certified with a return receipt to the Club at 3111 Hayden Road, Columbus, Ohio 43235. In the event a Primary Member cancels their Membership Agreement within the initial term of the membership with a 30 day notification in person or a 30 day written notification by U.S. Postal Service, certified with a return receipt to the Club at 3111 Hayden Road, Columbus, Ohio 43235, the Primary Member will be charged a cancellation fee, if applicable (12 months, $99 to cancel, 18 months, $149 to cancel, 24 months, $199) in the amount set forth on the first page of this membership agreement as it pertains to the type of membership purchased.
b. Notice of Cancellation: The Primary Member’s right to cancel this Membership Agreement under Ohio law is detailed in the attached “Notice of Cancellation”. If the Primary Member cancels this Membership Agreement pursuant to the attached “Notice of Cancellation”, such Member must submit to the Club evidence of delivery of such written notice upon request by the Club. If notice is sent by certified or overnight mail, notice shall be effective upon the date of post marking. The Primary Member must provide his or her copy of U.S. Postal Service return receipt to the Club upon request. If written notice is sent by manual delivery or personal delivery, such notice is effective when delivered to the Club. The Primary Member acknowledges that the “Notice of Cancellation” attached hereto has been delivered to such Member and further acknowledges that the Club has orally notified such Member of his or her right to cancel this Membership Agreement under Ohio law as of the Membership Agreement Execution Date noted herein.

Release of Liability

In consideration of any and all participation in Premier at Sawmill Athletic Club, LLC programs, activities, and use of facilities and equipment, the undersigned (1) agrees and understands that the risk of serious and permanent injury from the activities in The Club does exist; (2) knowing and freely assumes all risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assumes full responsibility for participation and use of the facilities; (3) willingly agrees to comply with the stated and customary terms and conditions for participation; (4) agrees that if any unusual or significant hazard is observed, activities will be discounted and such matter will be brought to the attention of the nearest official immediately; and (5) for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby releases and holds harmless the Premier at Sawmill Athletic Club, LLC, its owners, officers, agents and/or employees, other participants, and, if applicable, owners and lessors of premises (Releasees), with respect to any and all injury, disability, death, or loss or damage to person or property, including vehicles parked on premises, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.
I have read this release of liability and assumption of risk agreement; fully understand its terms, fully understand that I have given up substantial rights by signing it, and sign it freely and voluntarily.
Parent/Guardians Release of Liability

For Parents/Guardians of dependents under the age of 23 (under the age of 22 at time of registration)
This is to certify that I, as parent/guardian with legal responsibility for this dependent/participant, do consent and agree to his/her release, as provided above, of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liability incident to my dependents involvement or participation in these programs as provided above, even if arising from the Releasees negligence, to the fullest extent permitted by law.
